These Terms govern use of caventahealth.com and related public-facing pages/forms operated by Caventa Health LLC, d/b/a Caventa ("Caventa").
1. General information only
Public Site content is general information and does not constitute individualized medical advice, diagnosis, or treatment. Use of the public Site alone does not create a physician-patient relationship.
2. Emergencies
Do not use the public Site, email, waitlist form, or ordinary text messaging for emergencies. Call 911 or seek emergency care.
3. Eligibility and state availability
Caventa is an adult telemedicine practice. Availability depends on the patient's physical location and the states in which Dr. Kettler and Caventa are legally authorized and actively accepting patients. Website access or a marketing statement does not guarantee eligibility or enrollment.
4. Waitlist and enrollment
A waitlist/contact submission or informational meet-and-greet does not create a physician-patient relationship or DPC membership. Enrollment occurs only after Caventa accepts the patient and the required agreement, state addendum, consents, payment authorization, and other enrollment documents are completed.
5. Patient portal
If the Site links to an EHR/patient portal, the portal is governed by Caventa's patient agreements, HIPAA Notice of Privacy Practices, and applicable vendor terms. Portal communications do not guarantee an immediate response.
6. No guarantee of treatment or prescribing
Nothing on the Site guarantees that Caventa will accept a person as a patient or provide any particular diagnosis, treatment, prescription, referral, test, response time, or other service. Caventa does not prescribe controlled substances under its current membership model.
7. Acceptable use
Users may not attempt unauthorized access, disrupt Site operation, introduce malicious code, scrape the Site in violation of law or written restrictions, impersonate another person, or use the Site unlawfully.
8. Intellectual property
Site content, branding, graphics, and design are owned by or licensed to Caventa except where otherwise indicated. Personal, noncommercial viewing is permitted; other copying or reuse requires permission unless law provides otherwise.
9. Third-party services and links
The Site may link to EHR, payment, laboratory, scheduling, or other third-party services. Caventa is not responsible for independent third-party content or practices outside Caventa's control. Patient information handled by Caventa's vendors is addressed through Caventa's privacy/security program and applicable agreements.
10. Privacy and health-record requests
Use of the public Site is subject to Caventa's Website Privacy Policy. Clinical information collected through Caventa's patient enrollment or care workflow is governed by Caventa's HIPAA Notice of Privacy Practices and applicable state law. The Website Privacy Policy includes instructions for health-record requests and Texas privacy/licensing complaints.
11. Disclaimers
To the fullest extent permitted by law, the public Site is provided "as is" and "as available." Caventa does not warrant uninterrupted or error-free operation. Nothing in these Terms limits liability that cannot lawfully be limited.
12. Changes
Caventa may update these Terms. Continued use after changes constitutes acceptance to the extent permitted by law; changes to patient care or membership obligations are governed by the separate patient agreements.
